Article 1

1.

This Decision establishes at Union level the protection and surveillance zones to be established by the Member States listed in the Annex to this Decision hereto (the concerned Member States), following an outbreak or outbreaks of highly pathogenic avian influenza (HPAI) in poultry or other captive birds in accordance with Article 16(1) of Directive 2005/94/EC and the duration of the measures to be applied in accordance with Article 29(1) and Article 31 of Directive 2005/94/EC.

This Decision lays down rules concerning the dispatch of consignments of hatching eggs from the concerned Member States.

Article 2

The concerned Member States shall ensure that:

  1. the protection zones established by their competent authorities, in accordance with Article 16(1)(a) of Directive 2005/94/EC, comprise at least the areas listed as protection zones in Part A of the Annex to this Decision;

  2. the measures to be applied in the protection zones, as provided for in Article 29(1) of Directive 2005/94/EC, are maintained until at least the dates for the protection zones set out in Part A of the Annex to this Decision.

Article 3

The concerned Member States shall ensure that:

  1. the surveillance zones established by their competent authorities in accordance with Article 16(1)(b) of Directive 2005/94/EC, comprise at least the areas listed as surveillance zones in Part B of the Annex to this Decision;

  2. the measures to be applied in the surveillance zones, as provided for in Article 31 of Directive 2005/94/EC, are maintained until at least the dates for the surveillance zones set out in Part B of the Annex to this Decision.

Article 4

1.

The competent authorities of the concerned Member States may authorise the direct transport of consignments of hatching eggs from establishments of origin and designated hatcheries in the areas in their territory listed in the Annex to vaccine-manufacturing establishments located outside those areas in their territory or in the territory of another Member State subject to compliance with all of the following conditions:

  1. the direct transport of the consignment is ensured from the establishment of origin to the vaccine-manufacturing establishment of destination; or from the establishment of origin to the designated hatchery and from there to the vaccine-manufacturing establishment of destination;

  2. the parent flock from which the hatching eggs are derived was not affected by HPAI within the period of 21 days prior to the date of collection of those hatching eggs in the establishment of origin;

  3. the parent flock from which the hatching eggs are derived has been subjected to clinical and virological surveillance in accordance with point 8.10 of Chapter IV of the Annex to Commission Decision 2006/437/EC(1), with favourable results;

  4. a clinical visit of the poultry in all the production units of the establishment of origin during a period of 72 hours preceding the time of dispatch of the consignment has given a favourable result;

  5. the hatching eggs, as well as their packaging, have been disinfected before dispatch from the establishment of origin, and where applicable from the designated hatchery, in accordance with the instructions of the official veterinarian and the tracing back of these eggs can be ensured;

  6. the hatching eggs are transported in vehicles sealed by the competent authority or under its supervision from the establishment of origin, and where applicable from the designated hatchery;

  7. biosecurity measures are applied in the establishment of origin, and where applicable in the designated hatchery, in accordance with the instructions of the competent authority of the place of dispatch;

  8. the competent authority of the Member State of destination has given its prior consent for such movement to take place in advance of the movement from the establishment of origin or where applicable from the designated hatchery.

The concerned Member States shall ensure that the veterinary certificates for trade within the Union provided for in Article 20 of Directive 2009/158/EC, and set out in Annex IV thereto, accompanying the consignments of hatching eggs referred to in paragraph 1 of this Article to be dispatched to other Member States include the following sentence: ‘The consignment complies with the animal health conditions laid down in Commission Implementing Decision (EU) 2020/1809’.

Article 5

Implementing Decisions (EU) 2020/47, (EU) 2020/1606 and (EU) 2020/1664 are repealed.
