Decision of the EEA Joint Committee No 196/2012 of 26 October 2012 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

  1. Commission Decision 2010/11/EU of 7 January 2010 on the safety requirements to be met by European standards for consumer-mounted childproof locking devices for windows and balcony doors pursuant to Directive 2001/95/EC of the European Parliament and of the Council(1) is to be incorporated into the EEA Agreement.

  2. Commission Decision 2010/376/EU of 2 July 2010 on the safety requirements to be met by European standards for certain products in the sleep environment of children pursuant to Directive 2001/95/EC of the European Parliament and of the Council(2) is to be incorporated into the EEA Agreement.

  3. Commission Implementing Decision 2012/48/EU of 26 January 2012 extending the validity of Decision 2009/251/EC requiring Member States to ensure that products containing the biocide dimethylfumarate are not placed or made available on the market(3) is to be incorporated into the EEA Agreement.

  4. Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XIX of Annex II to the EEA Agreement shall be amended as follows:

  1. the following indent shall be added in point 3n (Commission Decision 2009/251/EC):

    • 32012 D 0048: Commission Implementing Decision 2012/48/EU of 26 January 2012 (OJ L 26, 28.1.2012, p. 35).’;

  2. the following points shall be inserted after point 3n (Commission Decision 2009/251/EC):

    • 32010 D 0011: Commission Decision 2010/11/EU of 7 January 2010 on the safety requirements to be met by European standards for consumer-mounted childproof locking devices for windows and balcony doors pursuant to Directive 2001/95/EC of the European Parliament and of the Council (OJ L 4, 8.1.2010, p. 91).

    • 32010 D 0376: Commission Decision 2010/376/EU of 2 July 2010 on the safety requirements to be met by European standards for certain products in the sleep environment of children pursuant to Directive 2001/95/EC of the European Parliament and of the Council (OJ L 170, 6.7.2010, p. 39).’.

Article 2

The texts of Decisions 2010/11/EU and 2010/376/EU and Implementing Decision 2012/48/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 1 November 2012, provided that all the notifications under Article 103(1) of the EEA Agreement have been made to the EEA Joint Committee(****).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
