Decision of the EEA Joint Committee No 181/2014 of 25 September 2014 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2015/1249]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

  1. Commission Delegated Directive 2014/69/EU of 13 March 2014 amending, for the purposes of adapting to technical progress, Annex IV to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in dielectric ceramic in capacitors for a rated voltage of less than 125 V AC or 250 V DC for industrial monitoring and control instruments(1) is to be incorporated into the EEA Agreement.

  2. Commission Delegated Directive 2014/70/EU of 13 March 2014 amending, for the purposes of adapting to technical progress, Annex IV to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in micro-channel plates (MCPs)(2) is to be incorporated into the EEA Agreement.

  3. Commission Delegated Directive 2014/71/EU of 13 March 2014 amending, for the purposes of adapting to technical progress, Annex IV to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in solder in one interface of large area stacked die elements(3) is to be incorporated into the EEA Agreement.

  4. Commission Delegated Directive 2014/72/EU of 13 March 2014 amending, for the purposes of adapting to technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in solders and termination finishes of electrical and electronic components and finishes of printed circuit boards used in ignition modules and other electrical and electronic engine control systems(4) is to be incorporated into the EEA Agreement.

  5. Commission Delegated Directive 2014/73/EU of 13 March 2014 amending, for the purposes of adapting to technical progress, Annex IV to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in platinized platinum electrodes used for conductivity measurements(5) is to be incorporated into the EEA Agreement.

  6. Commission Delegated Directive 2014/74/EU of 13 March 2014 amending, for the purposes of adapting to technical progress, Annex IV to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead used in other than C-press compliant pin connector systems for industrial monitoring and control instruments(6) is to be incorporated into the EEA Agreement.

  7. Commission Delegated Directive 2014/75/EU of 13 March 2014 amending, for the purposes of adapting to technical progress, Annex IV to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for mercury in cold cathode fluorescent lamps (CCFLs) for back-lighting liquid crystal displays, not exceeding 5 mg per lamp, used in industrial monitoring and control instruments placed on the market before 22 July 2017(7) is to be incorporated into the EEA Agreement.

  8. Commission Delegated Directive 2014/76/EU of 13 March 2014 amending, for the purposes of adapting to technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for Mercury in hand crafted luminous discharge tubes (HLDTs) used for signs, decorative or architectural and specialist lighting and light-artwork(8) is to be incorporated into the EEA Agreement.

  9. Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indents are added in point 12q (Directive 2011/65/EU of the European Parliament and of the Council) of Chapter XV of Annex II to the EEA Agreement:

  • 32014 L 0069: Commission Delegated Directive 2014/69/EU of 13 March 2014 (OJ L 148, 20.5.2014, p. 72),

  • 32014 L 0070: Commission Delegated Directive 2014/70/EU of 13 March 2014 (OJ L 148, 20.5.2014, p. 74),

  • 32014 L 0071: Commission Delegated Directive 2014/71/EU of 13 March 2014 (OJ L 148, 20.5.2014, p. 76),

  • 32014 L 0072: Commission Delegated Directive 2014/72/EU of 13 March 2014 (OJ L 148, 20.5.2014, p. 78),

  • 32014 L 0073: Commission Delegated Directive 2014/73/EU of 13 March 2014 (OJ L 148, 20.5.2014, p. 80),

  • 32014 L 0074: Commission Delegated Directive 2014/74/EU of 13 March 2014 (OJ L 148, 20.5.2014, p. 82),

  • 32014 L 0075: Commission Delegated Directive 2014/75/EU of 13 March 2014 (OJ L 148, 20.5.2014, p. 84),

  • 32014 L 0076: Commission Delegated Directive 2014/76/EU of 13 March 2014 (OJ L 148, 20.5.2014, p. 86).’

Article 2

The texts of Delegated Directives 2014/69/EU, 2014/70/EU, 2014/71/EU, 2014/72/EU, 2014/73/EU, 2014/74/EU, 2014/75/EU and 2014/76/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 26 September 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*********).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
