VERORDENING (EG) Nr. 3361/94 VAN DE RAAD van 29 december 1994 tot opening van tariefcontingenten voor Oostenrijk, Finland en Zweden
DE RAAD VAN DE EUROPESE UNIE,
Gelet op het Verdrag tot oprichting van de Europese Gemeenschap, inzonderheid op artikel 113,
Gezien het voorstel van de Commissie,
Overwegende dat Oostenrijk, Finland en Zweden, overeenkomstig artikel 2 van de Akte betreffende de voorwaarden voor de toetreding van deze landen tot de Gemeenschap, met ingang van 1 januari 1995 het gemeenschappelijk douanetarief toepassen;
Overwegende dat na deze toetredingen onderhandelingen dienen plaats te vinden overeenkomstig artikel XXIV, lid 6, van de Algemene Overeenkomst betreffende Tarieven en Handel 1994 (GATT 1994), teneinde een regeling te treffen voor de gevallen waarin de toepassing van het gemeenschappelijk douanetarief door de nieuwe Lid-Staten een wijziging of intrekking van eerder door deze landen verleende tariefconcessies ten gevolge heeft;
Overwegende dat de toepassing van het gemeenschappelijk douanetarief door de nieuwe Staten een verlaging van bepaalde invoerrechten en een verhoging van bepaalde andere rechten ten gevolge zal hebben;
Overwegende dat de Gemeenschap haar handelspartners tijdelijk compensatie dient te geven voor de produkten waarvoor de invoerrechten het sterkst worden verhoogd; dat bepaalde douanerechten derhalve autonoom dienen te worden verlaagd voor de periode van 1 januari tot en met 30 juni 1995, waarna de onderhandelingen dienen te worden voltooid;
Overwegende dat de Instellingen van de Europese Unie vóór de toetreding de maatregelen overeenkomstig artikel 169 van de Toetredingsakte kunnen vaststellen, en dat deze maatregelen in werking treden onder voorbehoud en op de datum van inwerkingtreding van het Toetredingsverdrag,
HEEFT DE VOLGENDE VERORDENING VASTGESTELD:
Artikel 1
1. De Republiek Oostenrijk, de Republiek Finland en het Koninkrijk Zweden passen met ingang van 1 januari tot en met 30 juni 1995 de in de bijlage vermelde invoerrechten toe ten aanzien van de produkten waarvoor in deze bijlage tariefcontingenten zijn vastgesteld.
2. Het bepaalde in lid 1 is van toepassing op voorwaarde dat de betrokken goederen:
- op het grondgebied van Oostenrijk, Finland of Zweden in het vrije verkeer worden gebracht en aldaar worden verbruikt of aldaar een bewerking ondergaan waardoor zij het karakter van produkt van oorsprong uit de Gemeenschap verwerven, en
- onder douanetoezicht blijven overeenkomstig de desbetreffende communautaire bepalingen inzake de bijzondere bestemmingen (Verordening (EEG) nr. 2913/92 van de Raad van 12 oktober 1992 tot vaststelling van het Communautair Douanewetboek, artikelen 21 en 82).
3. Het bepaalde in lid 1 is van toepassing op voorwaarde dat tot staving van de aangifte voor het vrije verkeer een door de bevoegde autoriteiten van Oostenrijk, Finland of Zweden afgegeven vergunning wordt overgelegd waaruit blijkt dat de betrokken goederen onder het toepassingsgebied van lid 1 vallen.
4. De Commissie en de bevoegde autoriteiten van Oostenrijk, Finland of Zweden nemen alle maatregelen die noodzakelijk zijn om te bewerkstellingen dat het eindverbruik van het betrokken produkt of de bewerking waardoor dit het karakter van produkt van oorsprong uit de Gemeenschap verwerft in Oostenrijk, Finland of Zweden plaatsvindt.
Artikel 2
Deze verordening treedt in werking op de datum van en onder voorbehoud van de inwerkingtreding van het Verdrag betreffende de toetreding van Oostenrijk, Finland en Zweden.
Deze verordening is verbindend in al haar onderdelen en is rechtstreeks toepasselijk in elke Lid-Staat.
