Commission Regulation (EC) No 1919/2006 of 11 December 2006 adapting several Regulations concerning the common organisation of the milk and milk products market by reason of the accession of Bulgaria and Romania to the European Union

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty of Accession of the Republic of Bulgaria and Romania, and in particular Article 4(3) thereof,

Having regard to the Act of Accession of the Republic of Bulgaria and Romania, and in particular Article 56 thereof,

Whereas:

  1. Certain technical amendments are necessary in several Commission Regulations concerning the common organisation of the milk and milk products market, in order to carry out the necessary adaptations by reason of the accession of Bulgaria and Romania to the European Union.

  2. Annex V to Commission Regulation (EC) No 2771/1999 of 16 December 1999 laying down detailed rules for the application of Council Regulation (EC) No 1255/1999 as regards intervention on the market in butter and cream(1) corresponds to the national quality class of butter produced in the Member States eligible for a private storage aid. That Annex should include the national quality class of Bulgaria and Romania.

  3. Annex II to Commission Regulation (EC) No 2799/1999 of 17 December 1999 laying down detailed rules for applying Council Regulation (EC) No 1255/1999 as regards the grant of aid for skimmed milk and skimmed-milk powder intended for animal feed and the sale of such skimmed-milk powder(2) consists of a list of products, distinguished by Member States, for which market prices should be communicated to the Commission on a regular base, provided that for the products defined, representative trade exists. That Annex should be extended to the list of representative products on the market of Bulgaria and Romania.

  4. Commission Regulation (EC) No 2535/2001 of 14 December 2001 laying down detailed rules for applying Council Regulation (EC) No 1255/1999 as regards the import arrangements for milk and milk products and opening tariff quotas(3) contains quotas opened for Bulgaria and Romania and related provisions for their application. It is therefore appropriate to delete point (b) of Article 5, point (a) of Article 19(1) and Annex I.B of that Regulation.

  5. Furthermore Article 18(1)(d), Article 21(1)(d), Article 28(1)(d), Article 37 and Article 44(3) of Regulation (EC) No 2535/2001 provide for certain entries in all Community languages. Those Articles should also provide for the entries in Bulgarian and Romanian.

  6. Article 2 of Commission Regulation (EC) No 580/2004 of 26 March 2004 establishing a tender procedure concerning export refunds for certain milk products(4) lays down detailed rules for establishing a standing invitation to tender. Commission Regulation (EC) No 581/2004 of 26 March 2004 opening a standing invitation to tender for export refunds concerning certain types of butter(5) and Commission Regulation (EC) No 582/2004 of 26 March 2004 opening a standing invitation to tender for export refunds concerning skimmed milk powder(6) provide separate invitations to tender for the mentioned products. Regulations (EC) No 581/2004 and (EC) No 582/2004 contain references to trade with Bulgaria and Romania. Such references should be deleted from the date of accession. Furthermore, the names and addresses of the competent authorities responsible for a tendering procedure in Bulgaria and Romania should also be included.

  7. Annexes VII, XIII, XV and XVI to Commission Regulation (EC) No 1898/2005 of 9 November 2005 laying down detailed rules for implementing Council Regulation (EC) No 1255/1999 as regards measures for the disposal of cream, butter and concentrated butter on the Community market(7) contain certain entries in all Community languages. Those provisions should also include the entries in Bulgarian and Romanian.

  8. Annex IV to Commission Regulation (EC) No 1282/2006 of 17 August 2006 laying down special detailed rules for the application of Council Regulation (EC) No 1255/1999 as regards export licences and export refunds for milk and milk products(8) contains certain entries in all Community languages of the Member States. These provisions should also include the entries in Bulgarian and Romanian.

  9. Regulations (EC) No 2771/1999, (EC) No 2799/1999, (EC) No 2535/2001, (EC) No 581/2004, (EC) No 582/2004, (EC) No 1898/2005 and (EC) No 1282/2006 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex V to Regulation (EC) No 2771/1999 is replaced by the text in Annex I to this Regulation.

Article 2

Annex II to Regulation (EC) No 2799/1999 is replaced by the text in Annex II to this Regulation.

Article 3

Regulation (EC) No 2535/2001 is amended as follows:

  1. In Article 5, point (b) is deleted.

  2. In Article 18(1), point (d) is replaced by the following:

    1. in box 20, the quota and one of the entries listed in Annex XV’.

  3. In Article 19(1), point (a) is deleted.

  4. In Article 21(1), point (d) is replaced by the following:

    1. in box 20, one of the entries listed in Annex XVI’.

  5. In Article 28(1), point (d) is replaced by the following:

    1. in box 20, where applicable, the quota number, the number of the IMA 1 certificate and its date of issue, in one of the entries listed in Annex XVII’.

  6. In Article 37, the first paragraph is replaced by the following:

    ‘By way of derogation from Article 26 of Regulation (EC) No 1291/2000, the competent licence-issuing authority shall endorse the licence in box 20 with one of the entries listed in Annex XVIII.’

  7. In Article 44(3), the first subparagraph is replaced by the following:

    ‘Where a physical check has been carried out, box 32 of import licences, or the message box in electronic licences, shall contain one of the entries listed in Annex XIX.’

  8. Annex I.B is deleted.

  9. The text in Annex III to this Regulation is added as Annexes XV to XIX.

Article 4

Regulation (EC) No 581/2004 is amended as follows:

  1. In Article 1(1) the second subparagraph is replaced by the following:

    ‘The products referred to in the first subparagraph are intended for export for all destinations except Andorra, Ceuta and Melilla, Gibraltar, the United States of America and Vatican City.’

  2. The Annex is replaced by the text in Annex IV to this Regulation.
