Uitvoeringsbesluit (EU) 2017/1593 van de Commissie van 20 september 2017 tot wijziging van de bijlage bij Uitvoeringsbesluit (EU) 2017/247 betreffende beschermende maatregelen in verband met uitbraken van hoogpathogene aviaire influenza in bepaalde lidstaten (Kennisgeving geschied onder nummer C(2017) 6458) (Voor de EER relevante tekst. )

DE EUROPESE COMMISSIE,

Gezien het Verdrag betreffende de werking van de Europese Unie,

Gezien Richtlijn 89/662/EEG van de Raad van 11 december 1989 inzake veterinaire controles in het intracommunautaire handelsverkeer in het vooruitzicht van de totstandbrenging van de interne markt⁽¹⁾, en met name artikel 9, lid 4,

Gezien Richtlijn 90/425/EEG van de Raad van 26 juni 1990 inzake veterinaire en zoötechnische controles in het intracommunautaire handelsverkeer in bepaalde levende dieren en producten in het vooruitzicht van de totstandbrenging van de interne markt⁽²⁾, en met name artikel 10, lid 4,

Overwegende hetgeen volgt:

Uitvoeringsbesluit (EU) 2017/247 van de Commissie⁽³⁾ is vastgesteld naar aanleiding van uitbraken van hoogpathogene aviaire influenza van het subtype H5 in een aantal lidstaten („de betrokken lidstaten”) en de instelling van beschermings- en toezichtsgebieden door de bevoegde autoriteiten van de betrokken lidstaten overeenkomstig artikel 16, lid 1, van Richtlijn 2005/94/EG van de Raad⁽⁴⁾.
In Uitvoeringsbesluit (EU) 2017/247 is bepaald dat de door de bevoegde autoriteiten van de betrokken lidstaten overeenkomstig Richtlijn 2005/94/EG ingestelde beschermings- en toezichtsgebieden ten minste de gebieden moeten omvatten die in de lijst van de bijlage bij dat uitvoeringsbesluit als beschermings- en toezichtsgebieden zijn opgenomen. In Uitvoeringsbesluit (EU) 2017/247 is ook vastgelegd dat de maatregelen die overeenkomstig artikel 29, lid 1, en artikel 31 van Richtlijn 2005/94/EG in de beschermings- en toezichtsgebieden moeten worden toegepast, ten minste tot de in de bijlage bij dat uitvoeringsbesluit voor die gebieden opgegeven data worden gehandhaafd.
Sinds de vaststelling ervan is Uitvoeringsbesluit (EU) 2017/247 verschillende keren gewijzigd, teneinde rekening te houden met de ontwikkelingen van de epidemiologische situatie in de Unie wat aviaire influenza betreft. Daarnaast is Uitvoeringsbesluit (EU) 2017/247 bij Uitvoeringsbesluit (EU) 2017/696 van de Commissie⁽⁵⁾ gewijzigd, teneinde regels vast te stellen met betrekking tot de verzending van zendingen eendagskuikens uit de in de bijlage bij Uitvoeringsbesluit (EU) 2017/247 opgenomen gebieden. Bij deze wijziging is rekening gehouden met het feit dat eendagskuikens in vergelijking met andere pluimveeproducten een zeer gering risico vormen voor de verspreiding van hoogpathogene aviaire influenza.
Daarnaast is de bijlage bij Uitvoeringsbesluit (EU) 2017/247 verschillende keren gewijzigd, teneinde rekening te houden met wijzigingen van de grenzen van de overeenkomstig Richtlijn 2005/94/EG door de betrokken lidstaten ingestelde beschermings- en toezichtsgebieden. Die bijlage is laatstelijk gewijzigd bij Uitvoeringsbesluit (EU) 2017/1519 van de Commissie⁽⁶⁾ naar aanleiding van de kennisgeving door Italië van uitbraken van hoogpathogene aviaire influenza van het subtype H5N8 in pluimveehouderijen in de regio's Lombardije en Veneto en de instelling van beschermings- en toezichtsgebieden door die lidstaat rond de besmette pluimveebedrijven in overeenstemming met Richtlijn 2005/94/EG.
Sinds de datum van de laatste wijziging van Uitvoeringsbesluit (EU) 2017/247 bij Uitvoeringsbesluit (EU) 2017/1519 heeft Italië, wederom in de regio's Lombardije en Veneto, nieuwe uitbraken van hoogpathogene aviaire influenza van het subtype H5N8 in pluimveehouderijen ontdekt en de Commissie hiervan in kennis gesteld. Italië heeft de Commissie ook geïnformeerd dat het de krachtens Richtlijn 2005/94/EG vereiste noodzakelijke maatregelen heeft genomen, waaronder de instelling van beschermings- en toezichtsgebieden rond de betrokken pluimveehouderijen.
De Commissie heeft de maatregelen die Italië overeenkomstig Richtlijn 2005/94/EG heeft genomen naar aanleiding van de recente uitbraken van hoogpathogene aviaire influenza van het subtype H5N8 in die lidstaat, bestudeerd en heeft geconstateerd dat de grenzen van de door de bevoegde autoriteiten van Italië ingestelde beschermings- en toezichtsgebieden op voldoende afstand liggen van de bedrijven waar een uitbraak van hoogpathogene aviaire influenza van het subtype H5N8 is bevestigd.
Om te voorkomen dat de handel in de Unie onnodig wordt verstoord en om te vermijden dat derde landen ongerechtvaardigde handelsbelemmeringen opwerpen, moeten de beschermings- en toezichtsgebieden die overeenkomstig Richtlijn 2005/94/EG in Italië zijn ingesteld naar aanleiding van de recente uitbraken van hoogpathogene aviaire influenza van het subtype H5N8 in die lidstaat, snel in samenwerking met Italië op het niveau van de Unie worden vastgesteld. Daarom moeten de vermeldingen voor Italië in de bijlage bij Uitvoeringsbesluit (EU) 2017/247 worden bijgewerkt om rekening te houden met de huidige epidemiologische situatie in die lidstaat met betrekking tot die ziekte. Met name moeten er nieuwe vermeldingen voor bepaalde gebieden in de regio's Lombardije en Veneto worden toegevoegd teneinde deze nieuwe situatie aan te pakken.
De bijlage bij Uitvoeringsbesluit (EU) 2017/247 moet derhalve worden gewijzigd om de regionalisering op het niveau van de Unie bij te werken, de beschermings- en toezichtsgebieden die door Italië overeenkomstig Richtlijn 2005/94/EG zijn ingesteld naar aanleiding van de nieuwe uitbraken van hoogpathogene aviaire influenza in de regio's Lombardije en Veneto, op te nemen en de duur van de daarin geldende beperkingen aan te geven.
Uitvoeringsbesluit (EU) 2017/247 moet daarom dienovereenkomstig worden gewijzigd.
De in dit besluit vervatte maatregelen zijn in overeenstemming met het advies van het Permanent Comité voor planten, dieren, levensmiddelen en diervoeders,

HEEFT HET VOLGENDE BESLUIT VASTGESTELD:

Artikel 1

De bijlage bij Uitvoeringsbesluit (EU) 2017/247 wordt gewijzigd overeenkomstig de bijlage bij dit besluit.

Artikel 2

Dit besluit is gericht tot de lidstaten.
