THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council(1), and in particular Article 10(6) thereof,
Whereas:
As stated in recital 13 of Directive 2008/57/EC of the European Parliament and of the Council(2), European standards developed in the spirit of the new approach to technical harmonisation and standardisation may enable a presumption of conformity to be made with certain essential requirements of that Directive, particularly in the case of interoperability constituents and interfaces. Railway products which are in conformity with such harmonised standards or parts thereof, the references of which have been published in the Official Journal of the European Union, are presumed to be in conformity with the requirements covered by those standards or parts thereof set out in that Directive.
By letter M/483 of 28 January 2011, the Commission made a request to the European Committee for Standardisation (CEN), the European Committee for Electrotechnical Standardisation (Cenelec) and the European Telecommunications Standards Institute (ETSI) for the drafting of new or the revision of existing standards in support of Directive 2008/57/EC.
On the basis of the request M/483 CEN and Cenelec drafted or revised, inter alia, the following harmonised standards: EN 14067-4:2013+A1:2018, EN 14067-6:2018, EN 14198:2016+A1:2018, EN 14363:2016+A1:2018, EN 15355:2019, EN 15610:2019, EN 15877-1:2012+A1:2018, EN 16186-1:2014+A1:2018, EN 16186-3:2016+A1:2018, EN 16452:2015+A1:2019, EN 16729-4:2018, EN 16922:2017+A1:2019, EN 17023:2018, EN 17069-1:2019, EN 50122-1:2011/A1:2011, EN 50122-1:2011/A2:2016, EN 50122-1:2011/A3:2016, EN 50122-1:2011/A4:2017 EN 50126-1:2017, EN 50126-2:2017, EN 50129:2018 together with its Corrigenda EN 50129:2018/AC:2019-04, EN 50318:2018, EN 50463-1:2017, EN 50463-2:2017 together with its Corrigenda EN 50463-2:2017/AC:2018-10, EN 50463-3:2017, EN 50463-4:2017 and EN 50463-5:2017.
The Commission, together with the CEN and the Cenelec, has assessed whether those standards, drafted or revised by the CEN and the Cenelec, comply with request M/483.
These standards satisfy the requirementswhich they aim to cover and which are set out in Directive 2008/57/EC. It is therefore appropriate to publish the references of those standards in the Official Journal of the European Union. Given that compliance with standard EN 14363:2016+A1:2018 does ensure compliance with the corresponding requirements set out in Directive 2008/57/EC only when used in conjunction with the technical opinion of the European Union Agency for Railways ERA-OPI-2018-3, the references to that standard should therefore be published in the Official Journal of the European Union with the corresponding restriction.
Some of the new or revised harmonised standards drafted by CEN and Cenelec replace the following harmonised standards: EN 14067-4:2005+A1:2009, EN 14067-6:2010, EN 14198:2016, EN 15355:2008+A1:2010, EN 15610:2009, EN 15877-1:2012, EN 16186-3:2016, EN 16922:2017, EN 50122-1:2011, EN 50126-1:1999, EN 50129:2003, EN 50463-1:2012, EN 50463-2:2012, EN 50463-3:2012, EN 50463-4:2012 and EN 50463-5:2012. It is therefore necessary to withdraw the references to those standards from the Official Journal of the European Union(3). For some of those standards, in order to give manufacturers sufficient time to prepare for application of the replacing standards, it is necessary to defer the withdrawal of their references.
Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union. This Decision should therefore enter into force on the date of its publication,
HAS ADOPTED THIS DECISION:
Article 1
The references of harmonised standards drafted in support of Directive 2008/57/EC, listed in Annex II to this Decision, are hereby published in the Official Journal of the European Union with restriction.
Article 2
The references of harmonised standards drafted in support of Directive 2008/57/EC, listed in Annex III to this Decision, are hereby withdrawn from the Official Journal of the European Union as from the dates set out in that Annex.
Article 3
This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.
