THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union(1) and in particular Articles 13(3) and 14(5) thereof,

After having informed the Member States,

Whereas:

    HAS ADOPTED THIS REGULATION:

    Article 1

    An investigation is initiated pursuant to Article 13(3) of Regulation (EU) 2016/1036, in order to determine if imports into the Union of monosodium glutamate in mixture or in solution, containing by dry weight 50 % or more of monosodium glutamate, currently falling under CN codes ex21039090, ex21041000, ex21042000, ex38249992, ex38249993 and ex38249996 (TARIC codes 2103909011, 2103909081, 2104100011, 2104100081, 2104200011, 3824999298, 3824999389 and 3824999689), originating in the People’s Republic of China, are circumventing the measures imposed by Commission Implementing Regulation (EU) 2015/83.

    Article 2

    1.

    The customs authorities of the Member States shall, pursuant to Article 13(3) and Article 14(5) of Regulation (EU) 2016/1036, take the appropriate steps to register the imports into the Union identified in Article 1 of this Regulation.

    2.

    Registration shall expire nine months following the date of entry into force of this Regulation.

    3.

    The Commission may direct customs authorities to cease registration in respect of imports into the Union of products made by exporters/producers having applied for an exemption from registration and having been found to fulfil the conditions for an exemption to be granted.

    Article 3

    1.

    Interested parties must make themselves known by contacting the Commission within 15 days from the date of entry into force of this Regulation.

    2.

    Interested parties, if their representations are to be taken into account during the investigation, must make themselves known by contacting the Commission, present their views in writing and submit questionnaire replies or any other information within 37 days from the date of entry into force of this Regulation, unless otherwise specified.

    3.

    Interested parties may also apply to be heard by the Commission within the same 37-day time limit. For hearings pertaining to the initiation stage of the investigation the request must be submitted within 15 days of the date of entry into force of this Regulation. Any request to be heard must be made in writing and must specify the reasons for the request.

    Article 4

    This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
