THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 2014/33/EU of the European Parliament and of the Council of 26 February 2014 on the harmonisation of the laws of the Member States relating to lifts and safety components for lifts(1), and in particular Article 39(1) thereof,

Whereas:

    HAS ADOPTED THIS DECISION:

    Article 1

    The measure taken by Germany, which was adopted by the Central Authority of the Länder for Safety Technology on 26 November 2015 and notified to the Commission on 10 March 2016, to prohibit the placing on the market of the lift model M33v3 manufactured by Orona, Sociedad Cooperativa, Hernani, Spain, is not justified.

    Article 2

    This Decision is addressed to the Member States.
