Commission Regulation (EU) 2024/843 of 6 March 2024 correcting the Portuguese language version of Annexes II and III to Regulation (EC) No 1333/2008 of the European Parliament and of the Council on food additives

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1333/2008 of the European Parliament and of the Council of 16 December 2008 on food additives(1), and in particular Article 10(3) thereof,

Having regard to Regulation (EC) No 1331/2008 of the European Parliament and of the Council of 16 December 2008 establishing a common authorisation procedure for food additives, food enzymes and food flavourings(2), and in particular Article 7(5) thereof,

Whereas:

  1. The Portuguese language version of Annex II to Regulation (EC) No 1333/2008 contains mistranslations of a term in Part D, table ‘Food categories’, under item ‘03.’, in the column ‘Name’, as well as in Part E, table ‘Authorised food additives and conditions of use in food categories of foodstuffs’, category number ‘03’, in the category description (title) and in the entry E 405, in the column ‘Restrictions/Exceptions’, that narrow down the scope of products in which certain food additives can be used.

  2. The Portuguese language version of Annex III to Regulation (EC) No 1333/2008 contains a mistranslation of a term in Part 4, table ‘Food additives including carriers in food flavourings’, entry E 423, in the first row of the column ‘Flavouring categories to which the additive may be added’, that narrows down the scope of products in which certain food additives can be used.

  3. The Portuguese language version of Annexes II and III to Regulation (EC) No 1333/2008 should therefore be corrected accordingly. The other language versions are not affected.

  4. Those mistranslations were introduced by two Commission acts, namely Regulations (EU) No 1129/2011(3) and (EU) 2015/647(4). Therefore, based on the powers awarded by the European Parliament and the Council to the Commission to amend Regulation (EC) No 1333/2008 in Article 10(3) of that Regulation, the Commission adopts this correcting act.

  5. The measures provided for in this Regulation are in accordance with the opinions of the Standing Committee on Plants, Animals, Food and Feed, delivered prior to the adoption of Regulations (EU) No 1129/2011 and (EU) No 2015/647,

HAS ADOPTED THIS REGULATION:

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
