Commission Implementing Regulation (EU) 2026/98 of 15 January 2026 amending Implementing Regulation (EU) 2022/565 as regards the name of the holder of the authorisation for feed additives

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition⁽¹⁾, and in particular Article 13(3) thereof,

Whereas:

(1) A preparation of 3-nitrooxypropanol was authorised as feed additive (‘feed additive concerned’) by Commission Implementing Regulation (EU) 2022/565⁽²⁾.

(2) The holder of the authorisation for the feed additive concerned, DSM Nutritional Products Ltd, represented in the Union by DSM Nutritional Products Sp. z o.o., has submitted an application in accordance with Article 13(3) of Regulation (EC) No 1831/2003 proposing to change the name of the holder of the authorisation for the feed additive concerned to ‘dsm-firmenich Switzerland Ltd., represented in the EU by dsm-firmenich Austria GmbH’.

(3) The proposed change of the terms of the authorisation is purely administrative in nature and does not entail a new assessment of the feed additive concerned. The European Food Safety Authority was informed of the application.

(4) To allow dsm-firmenich Switzerland Ltd. to exploit its marketing rights, it is therefore appropriate to change the terms of the authorisation concerned.

(5) Implementing Regulation (EU) 2022/565 should therefore be amended accordingly.

(6) Since safety reasons do not require the immediate application of the amendments made by this Implementing Regulation, it is appropriate to allow a transitional period during which existing stocks of the feed additive may be used up.

(7) The measures provided for in this Implementing Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,

HAS ADOPTED THIS REGULATION:

Article 1 Amendment to Implementing Regulation (EU) 2022/565

Implementing Regulation (EU) 2022/565 is amended as follows:

in the title, the name of the holder of the authorisation ‘DSM Nutritional Products Ltd, represented in the Union by DSM Nutritional Products Sp. z o.o.’ is replaced by ‘dsm-firmenich Switzerland Ltd., represented in the EU by dsm-firmenich Austria GmbH’;
in the second column of the table in the Annex, the name ‘DSM Nutritional Products Ltd represented in the Union by DSM Nutritional Products Sp. z o.o.’ is replaced by ‘dsm-firmenich Switzerland Ltd. represented in the EU by dsm-firmenich Austria GmbH’.

Article 2 Transitional measure

The feed additive concerned, as produced and labelled before the date of entry into force of this Regulation in accordance with the rules applicable before that date, may continue to be placed on the market and used until stocks are exhausted.

Article 3 Entry into force

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
