Voorstel voor een BESCHIKKING VAN DE RAAD tot wijziging van Beschikking 1999/847/EG betreffende de verlenging van het communautaire actieprogramma voor civiele bescherming

TOELICHTING

1. In december 1999 is bij Beschikking 1999/847/EG [1] van de Raad het tweede communautaire actieprogramma voor civiele bescherming goedgekeurd. Het doel van dit actieprogramma is een betere bescherming van personen, het milieu en goederen in geval van natuurrampen en technologische rampen in de Gemeenschap te waarborgen. In dit actieprogramma wordt voorzien in een breed scala van projecten, uitwisselingen van deskundigen, workshops en andere activiteiten die de samenwerking en wederzijdse bijstand tussen de diensten voor civiele bescherming in de lidstaten moeten bevorderen. In het actieprogramma worden de inspanningen van de lidstaten op nationaal, regionaal en plaatselijk niveau ondersteund en aangevuld. In het huidige programma concentreert de Commissie haar inspanningen op een beperkt aantal grootschalige projecten met een bredere Europese impact. De nadruk ligt daarbij op enkele grootschalige projecten op het gebied van preventie, publieksvoorlichting, crisismanagement, rampengeneeskunde en het creëren van netwerken tussen de verschillende vrijwilligersorganisaties die op dit gebied actief zijn.

2. De afgelopen jaren hebben verschillende gebeurtenissen, zoals het ongeval met de Prestige, de bosbranden in de zomer van 2003 en de overstromingen in Zuid-Frankrijk eind 2003, duidelijk gemaakt dat actie op Europees niveau noodzakelijk is. Naar aanleiding van deze ongevallen werd vanuit verschillende lidstaten bijstand verleend, waaruit bleek dat er behoefte was aan een gemeenschappelijke voorbereiding en wederzijdse informatieverstrekking. Bovendien moeten de burgers van de EU beter worden geïnformeerd over de mogelijke ongevallen en de reactiemogelijkheden daarop. De projecten voor de opleiding van jongeren zijn bijzonder succesvol gebleken.

3. Aangezien het huidige communautaire actieprogramma voor civiele bescherming op 31 december 2004 afloopt, wordt voorgesteld de looptijd van het actieprogramma met twee jaar te verlengen, namelijk van januari 2005 tot en met december 2006.

DE RAAD VAN DE EUROPESE UNIE,

Gelet op het Verdrag tot oprichting van de Europese Gemeenschap, en met name op artikel 308,

Overwegende hetgeen volgt:

(1) Bij Beschikking 1999/847/EG van de Raad van 9 december 1999 betreffende een communautair actieprogramma voor civiele bescherming [4] is voorzien in communautaire maatregelen op het gebied van preventie, paraatheid en reactie op natuurrampen en door de mens veroorzaakte rampen, zowel op land als op zee, voor de periode van 1 januari 2000 tot en met 31 december 2004.

(2) Recente gebeurtenissen zoals de overstromingen in Midden- en Oost-Europa in de zomer van 2002, het ongeval met de Prestige in Spanje in november 2002 en de hittegolf en de zware bosbranden in Zuid-Europa in de zomer van 2003, tonen aan dat de maatregelen voor civiele bescherming die op Gemeenschapsniveau zijn getroffen, moeten worden voortgezet overeenkomstig Beschikking 1999/847/EG.

(3) Om te vermijden dat er een leemte ontstaat tussen het vervallen van Beschikking 1999/847/EG en de datum van toepassing van een nieuwe rechtsgrond, moet het bij Beschikking 1999/847/EG ingevoerde actieprogramma met een periode van twee jaar worden verlengd.

(4) Beschikking 1999/847/EG moet derhalve dienovereenkomstig worden gewijzigd,

HEEFT DE VOLGENDE BESCHIKKING GEGEVEN:

Artikel 1

Beschikking 1999/847/EG wordt als volgt gewijzigd:

a) In artikel 1, lid 1, wordt "31 december 2004" vervangen door "31 december 2006";

b) De eerste alinea van artikel 2, lid 3 wordt vervangen door:

"Het financiële referentiebedrag voor de tenuitvoerlegging van het programma beloopt 7,5 miljoen euro voor de periode van 1 januari 2000 tot en met 31 december 2004 en 4,8 miljoen euro voor de periode van 1 januari 2005 tot en met 31 december 2006".

Artikel 2

Deze beschikking is gericht tot de lidstaten.

5. DESCRIPTION AND GROUNDS

5.1. Need for Community intervention

5.1.1. Objectives pursued

Recent emergencies such as the floods in Southern France in 2002, the heat wave and extensive forest fires in southern Europe in the summer of 2003 and the terrorist attack in Madrid in March 2004 as well as the earthquakes in Algeria, Iran and Morocco show that there is a need to continue the action undertaken in the field of civil protection.

A global evaluation of the three current instruments, Civil Protection Action Programme, Community Mechanism and Marine Pollution framework, is ongoing in order to identify possible future areas for common action in this field. This may result in a new instrument which will cover the period 2007-2013.

Therefore, considering that the current Community action programme expires on 31 December 2004 it needs to be extended for a period of two year until 31 December 2006.

The Civil Protection Action Programme "is intended to support and supplement Member States' efforts at national, regional and local levels for the protection of persons, property and in so doing environment, in the event of natural and technological disasters, without prejudice to the internal division of competence in Member States. The aim is also to facilitate cooperation, exchange of experience and mutual assistance between Member States in this field."

It aims at the enhancement of civil protection capabilities of Member States, EEA and candidate countries for dealing with disasters, and in particular:

- prevention, forecasting, detection, preparedness for response and immediate aftercare, and analysis of the socioeconomic implications of disasters,

- workshops, training courses, exchange and secondment of experts, and exercises intended to stimulate civil protection cooperation,

- actions and pilot projects to increase capacity, speed and efficiency in emergency situations and support, information and awareness-raising activities including conferences with a civil protection theme,

- mobilisation of experts to reinforce and assist Member States or third countries facing natural disasters or technological accidents,

This proposal on the table will provide the extension of current Civil Protection Action Programme for the years 2005-2006.

5.2. Action envisaged and budget intervention arrangements

After the adoption of the decision the Commission will establish the rolling plan for the two

years, 2005-2006, and subsequently launch Call for proposals.

The actions covered by the present legislative proposal are carried out in accordance with the Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities.

5.3. Methods of implementation

The programme is managed directly by the Commission through Call for proposals and accompanying measures.

7. FOLLOW-UP AND EVALUATION

7.1. Follow-up arrangements

A global evaluation of the three current instruments, Civil Protection Action Programme, Mechanism and Marine Pollution framework is ongoing in order to identify possible future areas for common action in this field.

For the future the Commission is considering the possibility to streamline the three instruments into one single framework.

8. ANTI-FRAUD MEASURES

The proposed activities only consist of grants and expenditure on expert meetings. The latter will be subject to the Commission's usual control mechanisms and therefore there is no need for supplementary anti-fraud measures.
