EXPLANATORY MEMORANDUM
Request by the French authorities:
On 4 February 2025, the French authorities requested the empowerment by the European Union for France to accede to the Inter-American Convention for the Protection and Conservation of Sea Turtles (hereinafter 'the Convention') 1 .
The Convention:
The Convention is an intergovernmental treaty that provides the legal framework allowing countries on the American continent to take measures to protect six species: loggerhead sea turtles, green sea turtles, leatherback sea turtles, hawksbill sea turtles, Kemp's ridley sea turtles, and olive ridley sea turtles.
The Convention entered into force in May 2001 and currently has sixteen contracting parties: Argentina, Belize, Brazil, Chile, Costa Rica, Dominican Republic, Ecuador, Guatemala, Honduras, Mexico, Netherlands, Panama, Peru, United States, Uruguay, and Venezuela.
The objective of the Convention is to promote the protection, conservation, and recovery of marine turtle populations and the habitats on which they depend, based on the best available data and taking into account the environmental, socioeconomic, and cultural characteristics of the Parties (Article II, text of the Convention).
The Convention covers measures focused on: prohibiting the intentional capture, possession, or killing of marine turtles, as well as trade in these species and their eggs, parts, or derivatives; exceptions may be made by States, provided they do not prejudice efforts to achieve the objective of the Convention; compliance with the obligations imposed by CITES concerning sea turtles, their eggs, parts or products; the protection and, where necessary, restoration of habitats, breeding sites, including through regulations restricting the use of those habitats, including the designation of protected areas; the promotion of scientific research on this subject and research on experimental reproduction, breeding and reintroduction, in order to determine the feasibility of these practices and to increase their population; promotion of environmental education and dissemination of information to encourage the participation of government institutions, NGOs and the general public; the requirement that all shrimp trawlers under the jurisdiction of the States Parties be equipped with marine turtle exclusion devices (TEDs) to avoid by-catches of sea turtles; the fight against illegal, unreported and unregulated fishing in its various forms, coastal from neighbouring countries including Brazil, Suriname and Guyana, or deep sea fishing through long-liners targeting tuna in particular.
The European Union empowers France to accede to the Convention, as the Convention is open for accession to States in the Americas and it is in line with the Union’s policy to protect marine biological resources in Union waters, in this case to undertake measures to protect sea turtles. The Convention includes measures for the conservation and sustainable exploitation of marine biological resources, in particular the reduction, to the greatest extent practicable, of the incidental capture, retention, harm or mortality of sea turtles in the course of fishing activities, through the appropriate regulation of such activities, and the development, improvement and use of appropriate gear, devices or techniques, and the corresponding training, in keeping with the principle of the sustainable use of fisheries resources.
As the content of the Convention falls under the European Union’s exclusive competence, it is necessary that an empowerment under Article 2(1) TFEU be granted by the Union legislator, in accordance with the ordinary legislative procedure foreseen in Article 43 TFEU, prior to the accession of France to the Convention.
This proposal complements and is generally consistent with other provisions of Union law in this area.

Empowerment under Article 2(1) TFEU should be granted by the Union legislator, in accordance with the legislative procedure referred to in Article 43 TFEU. The proposed act, in its nature is an empowerment to a Member State, is to be adopted in response to a corresponding request made by France. It should therefore take the form of a decision, addressed to France. Consequently, the proposed Decision of the European Parliament and of the Council represents an adequate instrument to empower France, in accordance with Article 2(1) TFEU, to act in this matter.

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 43 thereof,
Having regard to the proposal from the European Commission,
Having regard to the opinion of the European Economic and Social Committee,
Acting in accordance with the ordinary legislative procedure,
Whereas:
By letter dated 4 February 2025, France requested the Commission to be empowered to accede to the Inter-American Convention for the Protection and Conservation of Sea Turtles in order to strengthen its cooperation with the countries bordering its territories on the American continent: Guadeloupe, French Guiana, Martinique, Saint Barthélemy, Saint Martin, and Saint Pierre and Miquelon in the area of protection of marine turtle species occurring in seas adjacent to the American continents and the Caribbean.
The matters covered by the Inter-American Convention for the Protection and Conservation of Sea Turtles fall within the Union's exclusive competence. Therefore, Member States may accede to this Convention only if empowered by the Union in accordance with Article 2(1) of the Treaty on the Functioning of the European Union.
The Inter-American Convention for the Protection and Conservation of Sea Turtles is in line with the Union’s policy to protect marine biological resources in Union waters, in this case, in particular, to undertake measures to protect sea turtles and it is open for accession to States in the Americas. Therefore, it is appropriate that the European Union empowers France to accede to this Convention.
France should report to the European Parliament, the Council and the Commission on the accession to the Inter-American Convention for the Protection and Conservation of Sea Turtles and cooperate with the Commission on positions related to decisions, recommendations and measures taken under this Convention. France should also regularly inform the Commission on the adoption of such decisions or measures.
HAVE ADOPTED THIS DECISION:
Article 1
France is hereby empowered to accede to the Inter-American Convention for the Protection and Conservation of Sea Turtles.
Article 2
France will inform the European Parliament and the Council on the accession to the Inter-American Convention for the Protection and Conservation of Sea Turtles and consult the Commission on positions related to decisions, measures and recommendations taken under the Convention, and regularly inform the Commission on adoption of decisions, measures and recommendations.

Compulsory: the best estimate of the digital technology-related investments entailed by the proposal/initiative should be included in the table below.
