Opinion of the Advocate General

Mr Advocate General Darmon delivered his Opinion on 16 May 1990.^(*) He proposed that the Court should declare that, by subjecting imports of extracts, concentrated soups, or stock cubes of animal or vegetable origin intended for consumption, from other Member States in which they were lawfully manufactured and marketed to a system of authorization by the minister and to restrictions relating to the composition, description and packaging of the products, the Italian Republic has failed to fulfil its obligations under Article 30 of the Treaty. He proposed that the Court should order the defendant to pay the whole of the costs, including those relating to the head of claim withdrawn by the Commission.
